Trees Covered This policy covers new, original artificial trees purchased within 48 hours (before or after this service agreement) if they are used in normal conditions only . (Void where prohibited by law) What Is Covered If, any tree covered by this agreement becomes unusable for any reason within the manufacturer's control (defect), such tree or component part thereof will be replaced with a replacement part or an equivalent new Treeforest tree on the basis set forth below. Some examples of causes or conditions normally beyond the manufacturer's control are:
This service contract is in addition to, and/or may be limited by, any other applicable written service contract (covering special trees or situations) you may have received. What Is Not Covered
Service contract Period And Pro Rata Percentages During the first year of service (Proof of Purchase must be attached to claim form) if the tree is worn less than 10%, the tree will be replaced without charge . After the free replacement period, the replacement price will be prorated based on years of service from the original purchase date (Proof of Purchase must be attached to claim form).
To determine the replacement price, the appropriate pro rata percentage is multiplied by Treeforest's then-current regular price. Appropriate taxes, will be added to the adjustment replacement price. Conditions and Exclusions TO THE EXTENT PERMITTED BY LAW, TREEFOREST DISCLAIMS LIABILITY FOR ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, LOSS OF TIME OR PROFITS, LOSS OF VEHICLE USE, OR INCONVENIENCE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGES. This policy applies only to the actual owner-user of the trees and only to trees used in the 48 contiguous United States or the District of Columbia. Customer shall pay for shipping if by water (i.e. offshore US Islands) Owner-User's Obligations The owner-user's obligation is to maintain and store trees within normal room temperatures when not in use and to maintain electrical components dry. In case of an adjustment claim, the owner-user must present the tree to an authorized Treeforest return site or store, complete and sign the customer section of the Treeforest adjustment claim form, attach to the claim form a copy of the Proof of Purchase showing the date the tree was purchased new . Present Treeforest with a copy of this form, and pay the appropriate replacement price, taxes and service charges for a new, current equivalent tree. Seller's obligation under this policy may not be enlarged or altered by anyone. Policy Conditions This policy only applies to the original purchaser of the tree , in normal indoor use. This is a statement of adjustment policy coverage only. Nothing in this policy is intended to be a representation that failures cannot occur. Customer agrees to be bound by policies and Terms and Conditions of seller. Determination by Seller shall be final and conclusive. |
